초록

본 연구의 목적은 외국인 계절근로자 지원 조례 비교 분석을 통한 광역자치단체 조례 개정안 도
출이다. 분석 조례는 국가법령정보센터 자치법규에서 수집하고, 전국 광역자치단체의 외국인
계절근로자 지원 조례를 분석대상으로 하여, 내용분석 방법으로 규범적 타당성과 규범적 실효
성 수준을 비교하였다. 분석 결과, 제주 조례는 자치단체장의 책무성, 자치단체장의 재정책임
성, 인력의 전문성에서 규범적 타당성과 실효성 수준이 높았다. 조례 개정 방안으로, 도구적･공
급자적･배제적 관점이 아닌 고용주와 외국인 계절근로자 모두가 공생･공존을 지향하도록 목적
조문 수정, ILO 및 국가인권위원회 기준에 기초한 적용대상 범위 확대, 이주 인권가이드라인 이
행 과제 신설 및 광역자치단체 간 지원사업 벤치마킹, 광역자치단체장의 재정책임성을 ‘도지사
/시장의 책무’ 및 ‘지원계획의 수립･시행’ 조항에 명시, 인권보호를 위한 광역자치단체의 지도･ 점검 기능 강화와 초광역 단위 연계형 종합정보시스템의 구축･운영, 언어소통도우미, 광역단위
담당변호사 제도 도입, 전담인력의 기준･양성 강화 등을 통해 전문인력 지원수준 제고, 벌칙 조
항 또는 행정권한을 활용한 제재 및 인센티브 조항 신설을 제시하였다.

The purpose of this study was to develop revisions to local ordinances supporting
foreign seasonal workers through a comparative analysis. Using content analysis, this
study was compared to the normative validity and effectiveness of ordinances
supporting foreign seasonal workers from local governments across the country. The
analysis revealed that the Jeju ordinance demonstrated high normative validity and
effectiveness. The proposed ordinance revision aims to foster coexistence and
prosperity for both employers and foreign seasonal workers, rather than focusing on
instrumental, supplier, or exclusionary perspectives. Based on ILO and National
Human Rights Commission standards, the scope of application has been expanded,
and new tasks have been established for implementing the Migrant Human Rights
Guidelines, and explicitly stipulates the fiscal responsibility of metropolitan heads.
Furthermore, the revision proposes strengthening the guidance and oversight
functions of governments for human rights protection, establishing and operating a
comprehensive information system linked to the broader metropolitan area, and
sanctions and incentives utilizing penalty provisions or administrative authority have
been established.
