초록

이 연구는 스페인에서 미등록 이주민을 대상으로 한 2005년 특별 합법화 조치가 단행된 맥락과 요인을 규명하는 것을 목표로 한다. 이 정책은 유럽 역사상 최대 규모이자 스페인에서는 마지막이었던 대규모 특별 합법화 정책이었다. 이는 이민 이슈가 이미 정치화되어 있었고 국민당에 의한 제한주의 이민정책이 탄력을 받고 있는 가운데 그 시행이 기대하기 어려웠음에도 불구하고 단행된 정책이었다. 그런 점에서 본 연구는 2005 합법화 정책 시행을 가능하게 만든 요인들을 규명하고, 그 과정과 결과를 평가한다. 이를 위해 우선 ‘합법화’에 대한 논의는 ‘불법화’에 대한 이해에서 출발해야 한다는 인식을 바탕으로 스페인 이민정치에 나타나는 ‘불법성’ 생산의 다양한 맥락들과 복합적 작동 방식을 분석한다. 이어서 국민당 집권기인 2000년 전후로 이민 이슈가 본격적으로 정치화된 경위를 살펴보고, 2004년 사회주의노동당으로의 정권 교체 이후 시민적 공화주의에 근간한 통치 철학을 사회개혁으로 구현하려 했던 호세 사파테로 정부 하에서 단행된 2005년 합법화 시행의 정치 동학과 특징을 정치적 리더십과 사회협약의 제도적 틀이라는 두 가지 요인을 중심으로 규명할 것이다. 마지막으로는 2005년 합법화 정책이 거둔 성취와 한계를 평가하고 시사점을 도출한다.

This article aims to examine the contexts and key factors of the 2005 Normalización in Spain, which as an extraordinary regularization programme legalized and regularized the status of undocumented migrants. This was the largest ever in number of applicants in European history of immigration, and so far the last extraordinary regularization policy in Spain. Firstly, under the recognition that any reasonable discussions of legalization requires the understanding of the process of illegalization, this article analyzes interconnected contexts behind and the complicated mechanism of the production of illegality, which resulted in so many and such a high proportion of undocumented migrants in the country. Then, the article explains as the backdrop of the 2005 Normalización the process of politicization of the issue of immigration over the period of the late 1990s to the early 2000s. Because the issue of immigration was already highly politicized and the restrictionist approach was getting more force, a large extraordinary regularization programme seemed to be very hard to be implemented. Then what were the key factors to make it possible in 2005? This study argues that political leadership of the prime minister José Zapatero and his government armed with the idea of civic republicanism on the one hand and the institutional arrangements for social agreement based on corporative representation on the other combined to lead to the realization of the 2005 Normalización. Finally, this article analyzes the results and limitations of, and draws lessons from the 2005 regularization programme. It is hoped that this study could help better understand the overall characteristics of Spanish politics of immigration through the analysis of 2005 Normalización as a historical event.
